Attorneys for Tyler Robinson, the man accused of fatally shooting Charlie Kirk last year, are seeking to delay his legal proceedings after they said federal authorities were unable to conclusively link a recovered bullet fragment to the alleged murder weapon.

In a recent court filing obtained by NBC News, Robinson’s defense team asked to postpone his upcoming May hearing so that they may have more time review evidence in the case, specifically a recent analysis from the Bureau of Alcohol, Tobacco, Firearms and Explosives. It said “that the ATF was unable to identify the bullet recovered at autopsy to the rifle allegedly tied” to their client.

A decades-old German-made bolt-action rifle — built for use in both World Wars — was found in a wooded area near the scene of the shooting.

Prosecutors have previously said DNA consistent with Robinson’s was found on the trigger of the firearm, the fired cartridge casing and two unfired cartridges. His defense team has meanwhile noted that forensic reports indicate multiple people’s DNA was found on some of those items, requiring further investigation.

Officials have identified the person accused of fatally shooting conservative activist Charlie Kirk as 22- year-old Utah resident Tyler Robinson.

The FBI is running additional tests, but they have not yet been completed, according to the filing.

Kirk was shot the afternoon of Sept. 10, 2025, during a Q&A at Utah Valley University as part of his American Comeback Tour with Turning Point USA. The conservative commentator was struck in the neck by a lone bullet during the outdoor event on the Orem campus and was rushed to a hospital, where he was pronounced dead a short time later. He was 31 years old.

Graphic video of the shooting later posted on social media sees Kirk seated under a white tent, addressing a question about mass shootings, when the sound of a single gunshot rings out. Blood can then be seen pouring from Kirk’s neck before he topples from his stool and falls to the floor.

President Donald Trump announced Robinson’s arrest a couple days later, and prosecutors have said they plan to seek the death penalty.

Robinson as not yet entered a plea and he is due in court in April for a hearing on a defense motion to ban cameras from the courtroom.
